1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of the NayaSports mobile application, web application, and related services (collectively, the "Service") provided by NayaSports (SMC-Private) Limited ("NayaSports", "we", "us", "our").
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. The Service
NayaSports is a platform that connects sports players with venue owners across Pakistan. The Service allows you to:
- Discover and book sports courts (futsal, cricket, padel, tennis, basketball, football, and more).
- Organise and join matches with other players.
- If you are a venue owner, list courts, manage availability, accept bookings, process payments, and manage staff.
We act as an intermediary between players and venue owners. We do not own, operate, or control any sports venue listed on the Service.
3. Eligibility
You must be at least 13 years old to create an account. If you are under the age of majority in Pakistan (18), you may use the Service only with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf.
Venue owner accounts must be created by individuals authorised to act on behalf of the venue business.
4. Account Registration and Security
- You must provide accurate, current, and complete information when registering.
- You are responsible for safeguarding your password and for all activity that occurs under your account.
- Notify us immediately at support@nayasports.com if you suspect unauthorised access.
- You may not share your account with another person or transfer it without our consent.
5. User Roles
5.1 Players
Players can browse venues, book courts, join matches, message venue owners, and submit ratings and reviews.
5.2 Venue Owners
Venue owners list and manage one or more sports venues. By creating a venue listing, you represent that you have the legal right to offer the venue for booking and to charge users for its use.
5.3 Staff
Venue owners may create staff accounts with limited permissions. Staff accounts are issued by the venue owner and are subject to the owner's control. Staff users may not create venues or change account roles.
6. Bookings, Cancellations, and Refunds
6.1 Booking
When you book a court, you enter into a direct contract with the venue owner. NayaSports facilitates the booking but is not a party to that contract.
6.2 Cancellation
Cancellation rules, deadlines, and any applicable fees are set by the individual venue owner and shown to you before you confirm the booking. By confirming, you agree to those rules.
6.3 Refunds
Refunds are processed by the venue owner in accordance with their stated policy. Where payment was collected through the Service, NayaSports will assist in routing approved refunds back to your original payment method. Processing times depend on the payment provider.
6.4 No-shows
If you fail to arrive at the venue at the booked time without cancelling, the booking is considered consumed and is not refundable unless the venue owner agrees otherwise.
7. Payments and Fees
Booking prices are set by venue owners. Where payment is collected through the Service, we may use third-party processors such as Safepay; their terms apply in addition to ours. NayaSports may deduct a service fee or commission from venue owner payouts, as agreed separately with each venue owner.
You are responsible for any taxes payable on your bookings or earnings as applicable under Pakistani law.
8. Venue Owner Obligations
- Provide accurate venue and court information, including pricing, hours, and amenities.
- Honour confirmed bookings and notify users promptly of any unavoidable cancellations.
- Maintain the venue and courts in safe, usable condition.
- Comply with all applicable laws, including tax, business licensing, and health and safety regulations.
- Treat players respectfully and respond to messages within a reasonable time.
- Complete KYC verification when required.
9. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms.
- Impersonate any person or misrepresent your affiliation with any person or organisation.
- Upload content that is harmful, defamatory, harassing, obscene, infringing, or otherwise objectionable.
- Interfere with or disrupt the integrity or performance of the Service.
- Attempt to gain unauthorised access to other accounts, systems, or data.
- Use automated means (bots, scrapers) to access the Service without our written permission.
- Resell or commercially exploit the Service without our written permission.
- Submit false ratings or reviews, or manipulate the rating system.
10. User Content
You retain ownership of any content you submit (photos, reviews, messages, venue listings). By submitting content, you grant NayaSports a non-exclusive, worldwide, royalty-free licence to use, host, store, reproduce, modify, and display that content for the purpose of operating and promoting the Service.
You represent that you own or have the necessary rights to all content you submit and that it does not violate any third party's rights.
We may remove content that violates these Terms or that we judge to be inappropriate, without notice.
11. Intellectual Property
The NayaSports name, logo, app, website, design system, and all related materials are the property of NayaSports (SMC-Private) Limited and protected by Pakistani and international intellectual property laws. You may not copy, modify, distribute, or create derivative works of any part of the Service without our prior written consent.
12. Third-Party Services
The Service integrates with third parties such as Google (maps, sign-in), Firebase (push notifications), Safepay (payments), and Supabase (real-time messaging). Your use of these features is also subject to those providers' terms. NayaSports is not responsible for the actions, content, or policies of third parties.
13. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that:
- The Service will always be available or error-free.
- Venue information will always be accurate, complete, or current.
- Bookings will be honoured by venue owners.
- Any specific results will be achieved from your use of the Service.
NayaSports does not control venue conditions, equipment quality, or interactions between users at venues. You participate in physical sports activities at your own risk.
14. Limitation of Liability
To the maximum extent permitted by law, NayaSports, its directors, employees, and partners are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.
Our total liability for any claim related to the Service is limited to the greater of (a) the total amount you paid us in the 12 months preceding the event giving rise to the claim, or (b) PKR 5,000.
15. Indemnification
You agree to indemnify and hold harmless NayaSports and its affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any third-party right, or (d) any content you submit.
16. Suspension and Termination
We may suspend or terminate your account, in whole or in part, at any time and without notice if:
- You materially breach these Terms.
- We are required to do so by law or by a competent authority.
- Your activity poses a security, fraud, or reputational risk to the Service or to other users.
You may delete your account at any time from within the app or by contacting support@nayasports.com. Sections that by their nature should survive (intellectual property, disclaimers, limitations, indemnification, governing law) will continue to apply after termination.
17. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to conflict-of-law principles. You agree that any dispute arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Lahore, Pakistan.
Before initiating any formal proceedings, you agree to first contact us at support@nayasports.com to attempt to resolve the dispute informally.
18. Changes to These Terms
We may update these Terms from time to time. Material changes will be announced in the app or by email at least 7 days before they take effect. The "Last updated" date at the top reflects the most recent revision. Continued use of the Service after changes take effect means you accept the revised Terms.
